Important: This is a general contract template. The service description, buyer details, price, taxes, performance date, and special terms must be completed and presented before payment for every order.

Buyer
The person or entity whose name, address, phone number, and e-mail address are collected during order or proposal approval.
2. Subject
This agreement governs the supply of software licenses, digital content, development, maintenance, installation, or other technology services ordered electronically, together with the parties’ rights and obligations under Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
3. Product or service information
The essential characteristics, scope, quantity, total price, taxes, payment method, delivery or performance period, and any subscription term are shown in the order summary and pre-information form. Those details form an integral part of this agreement.
4. Formation of the contract
The contract is formed when the buyer reviews and accepts the pre-information and order summary, then expressly confirms the order with a payment obligation. Receipt of the order is confirmed electronically.
5. Payment
Available methods are shown during payment. When card payments are enabled, they are processed through an authorised payment institution. Any additional cost, tax, or recurring charge is disclosed before approval.
6. Delivery and performance
Digital deliverables are supplied by e-mail, user account, or secure link. Services are performed according to the schedule and milestones in the proposal. If the buyer delays required access, content, or approval, the schedule may be adjusted by the same period.
7. Right of withdrawal
A consumer may generally withdraw from a service contract within fourteen days of its formation without giving a reason. A clear withdrawal notice may be sent to hello@cogitave.com.
If performance begins during the withdrawal period at the consumer’s express request, a proportional amount may be charged for the service supplied until withdrawal. The right is lost once the service has been fully performed with the consumer’s prior express consent and acknowledgement of that loss.
8. Exceptions to withdrawal
Subject to other statutory exceptions, the right of withdrawal does not apply to digital content supplied without a tangible medium once performance begins with the consumer’s express consent and acknowledgement that the right will be lost. Any such consent is collected separately before the order.
9. Refunds
Following a valid withdrawal notice, refundable amounts are returned within the statutory period, without cost to the consumer, using a method compatible with the original payment instrument. See the Cancellation & Refund Policy.
10. Intellectual property and licensing
Open-source components remain subject to their respective licenses. Source-code delivery, usage rights, and assignment terms for custom work are stated in the proposal or project agreement. Unless agreed otherwise, third-party rights remain with their owners.
11. Dispute resolution
Consumers may apply to the competent Consumer Arbitration Committee or Consumer Court under the applicable monetary and jurisdictional rules. The parties may first attempt to resolve the matter directly.
12. Entry into force
By approving electronically, the buyer confirms having read and accepted the pre-information form and this agreement. Mandatory consumer law and any provision more favourable to the consumer prevail in case of conflict.
